These Terms and Conditions apply to the use of luxuriouslanka.com and to travel services arranged by Luxurious Lanka.

Please read them carefully before submitting an enquiry, accepting a quotation, making a payment or confirming a booking. By confirming a booking with Luxurious Lanka, you acknowledge that you have read, understood and accepted these Terms and Conditions, together with the information and booking-specific conditions contained in your quotation, itinerary, invoice and confirmation documents.

1. About Luxurious Lanka

Luxurious Lanka is a Sri Lanka-based travel specialist arranging personalised holidays and related travel services in Sri Lanka and the Maldives.

For the purposes of these Terms and Conditions, “Luxurious Lanka”, “we”, “us” and “our” refer to:

“Traveller”, “you” and “your” refer to the lead traveller making the booking and every person travelling under that booking.

2. Scope of our services

Luxurious Lanka designs, arranges and coordinates personalised travel services. Depending on your confirmed itinerary, these services may include accommodation, private transport, airport transfers, chauffeur-guide services, excursions, activities, domestic travel and other holiday arrangements.

Some services are provided by independent hotels, transport companies, airlines, guides, activity operators and other third-party suppliers. These suppliers may apply their own booking, cancellation, payment, participation and operating conditions.

Only the services specifically listed in your final written quotation, confirmed itinerary or booking confirmation are included in your arrangements.

3. Enquiries and travel proposals

Submitting an enquiry through our website, email, telephone, WhatsApp or another communication channel does not create a confirmed booking.

Any proposed itinerary or quotation is prepared using the information available at the time. Accommodation, transport, activities, guides and other services remain subject to availability until your booking has been confirmed.

A quotation may include an expiry or acceptance date. Prices and availability may change after that date or before the required payment has been received.

Photographs, descriptions, maps and sample itineraries are provided for general guidance and inspiration. They do not guarantee the availability of a particular room, property, vehicle, guide, activity or experience.

4. Confirming your booking

Your booking will be considered confirmed when:

  1. You have accepted the final itinerary and quotation in writing.
  2. We have received the required deposit or full payment.
  3. You have provided the requested traveller information.
  4. We have issued written confirmation of the booking.

The lead traveller must be at least 18 years old and must have the authority to make the booking on behalf of everyone included in it.

The lead traveller is responsible for ensuring that all members of the travelling party receive the relevant booking information and agree to these Terms and Conditions.

5. Traveller information

You must provide complete and accurate information for each traveller. This may include full names as shown in passports, dates of birth, nationalities, passport details, contact information and any other information reasonably required to arrange the journey.

You must check all names, travel dates and booking details carefully before confirming the arrangements.

Luxurious Lanka will not be responsible for additional costs, delays, refused services or other difficulties resulting from incorrect, incomplete or late information supplied by a traveller.

You must inform us promptly if any information changes after the booking has been confirmed.

6. Prices and currency

The total price and applicable currency will be stated in your quotation, invoice or booking confirmation.

The confirmed price includes only the services expressly identified as included. Any item that is not specifically listed as included should be considered excluded.

Depending on your itinerary, exclusions may include international flights, visas, travel insurance, vaccinations, medical expenses, meals and drinks not mentioned in the itinerary, personal purchases, laundry, minibar charges, room service, gratuities, optional activities and excess baggage charges.

Bank fees, international transfer charges, card-processing fees and currency-conversion charges imposed by your bank or payment provider are your responsibility unless otherwise stated in writing.

7. Deposits and payments

The required deposit, payment schedule, accepted payment method and final balance deadline will be stated in your quotation, invoice or booking confirmation.

Some hotels, flights, seasonal reservations, promotional rates and special arrangements may require earlier payment or full non-refundable payment. These conditions will be explained before confirmation wherever they are known to us.

A payment is considered received only when cleared funds have reached the bank account or payment facility specified by Luxurious Lanka.

Where payment is not received by the stated deadline, we may be unable to hold the proposed services. The booking may be released or cancelled, subject to the conditions communicated to you.

We will make reasonable efforts to contact the lead traveller before releasing a confirmed arrangement because of non-payment.

8. Changes requested by you

Requests to change a confirmed booking must be submitted in writing by the lead traveller.

We will make reasonable efforts to accommodate the requested change, but changes remain subject to supplier availability and cannot be guaranteed.

You will be responsible for any additional supplier charges, price differences, cancellation fees, administrative expenses or other costs resulting from the requested change.

Where reasonably possible, we will explain the applicable costs before proceeding.

A substantial change to travel dates, destinations, accommodation, services or the identity of a traveller may need to be treated as a cancellation and a new booking.

9. Cancellation by you

Cancellation requests must be submitted in writing by the lead traveller. The cancellation will take effect from the date we receive the written request.

The cancellation conditions applicable to your holiday will be stated in your quotation, invoice or booking confirmation. These conditions may vary according to your travel dates, accommodation, transport, activities and supplier agreements.

Cancellation charges may include non-refundable deposits, supplier cancellation fees, costs already paid or committed on your behalf, bank charges, payment-processing fees and reasonable administrative costs.

Certain promotional rates, peak-season reservations, special-event arrangements, airline tickets and last-minute bookings may be partially or entirely non-refundable.

Where a refund is due, it will be processed after the refundable amount has been confirmed or recovered from the relevant suppliers. Processing times may depend on hotels, banks, airlines, payment providers and other third parties.

We strongly recommend obtaining suitable travel insurance that includes cancellation and curtailment cover.

10. Changes made by Luxurious Lanka

Occasionally, confirmed arrangements may need to be changed because of supplier decisions, operational requirements, weather conditions, safety concerns, road conditions or circumstances beyond our reasonable control.

Where a significant confirmed service becomes unavailable, we will make reasonable efforts to provide a suitable alternative of a similar standard, adjust the itinerary while preserving the overall nature of the journey or discuss other reasonable options with you.

A price adjustment may be offered where a replacement service has a materially different value.

Minor changes to timings, routes, the order of visits, vehicles, guides or similar operational details may be made where reasonably necessary.

We will communicate significant changes as soon as reasonably possible.

11. Cancellation by Luxurious Lanka

If we are required to cancel your entire booking for a reason within our reasonable control, we will discuss an appropriate alternative or refund the amount paid to us for services that will not be provided, subject to applicable law and any supplier charges or amounts that cannot be recovered.

Where cancellation results from circumstances beyond our reasonable control, the availability and amount of any refund will depend on supplier conditions, recoverable amounts and any applicable legal rights.

Luxurious Lanka will not cancel a confirmed booking solely to resell it at a higher price.

12. Independent suppliers

Hotels, airlines, transport companies, guides, activity providers and other independent suppliers are responsible for delivering their respective services.

Their own terms may apply to matters such as check-in times, cancellations, baggage, age restrictions, behaviour, health requirements, safety and participation in activities.

Luxurious Lanka will use reasonable care when selecting and coordinating suppliers. However, we do not control every action, omission or operational decision made by an independent supplier.

Nothing in these Terms and Conditions removes any responsibility that Luxurious Lanka is legally required to accept.

13. Accommodation

Accommodation standards and classification systems may differ between destinations and may not be the same as those used in your home country.

Room descriptions, facilities and hotel categories are based on information provided by the relevant accommodation provider.

Check-in and check-out times are determined by each property. Early check-in, late check-out, connecting rooms, adjoining rooms, specific views, particular floors and bedding arrangements remain subject to availability unless confirmed in writing.

Accommodation providers may temporarily change, restrict or close facilities because of maintenance, private events, weather, safety requirements or operational circumstances.

Travellers are responsible for settling personal expenses and paying for any damage caused by them directly to the accommodation provider.

14. Private transport and journey times

Journey times are estimates and may be affected by traffic, road conditions, weather, public events, security procedures and other circumstances.

Where private road transport is included, the vehicle type will be stated or described in your booking documents. A comparable replacement vehicle may be used where required for operational or safety reasons.

Travellers must wear seat belts whenever available and follow reasonable safety instructions provided by the driver, chauffeur-guide or relevant authorities.

Unscheduled route changes and additional services requested during the journey may result in additional charges.

15. Flights and baggage

Flights are included only when they are expressly stated in your confirmed itinerary.

Airline schedules, baggage allowances, check-in requirements, seating and ticket conditions are controlled by the relevant airline. Schedule changes, delays or cancellations may affect other parts of your itinerary.

Travellers are responsible for confirming the airline’s current baggage allowance and for carrying passports, medication, valuables and essential personal items appropriately.

Luxurious Lanka is not responsible for baggage that is lost, delayed or damaged while under the control of an airline or another transport provider. We will provide reasonable assistance in contacting the relevant provider where possible.

16. Passports, visas and entry requirements

Each traveller is responsible for holding a valid passport and obtaining all required visas, permits, health documents and travel authorisations.

Travellers must ensure that their passports meet the validity and blank-page requirements of every country included in the journey.

Entry requirements may vary according to nationality, country of residence, travel history and personal circumstances.

Any visa or entry information supplied by Luxurious Lanka is provided as general guidance. Travellers must confirm current requirements with the relevant embassy, consulate, immigration authority or authorised visa service before travelling.

Luxurious Lanka will not be responsible where a traveller is refused boarding, entry or participation because of missing, incomplete or invalid documentation.

17. Health, medical and mobility requirements

You are responsible for deciding whether the proposed journey is suitable for your health, mobility and personal circumstances.

Before travelling, you should obtain appropriate professional medical advice concerning vaccinations, medication, health precautions and your ability to participate in planned activities.

You must inform us before confirmation of any medical condition, allergy, dietary requirement, disability or mobility consideration that may materially affect the arrangements.

We will make reasonable efforts to communicate relevant requirements to suppliers. However, we cannot guarantee that every property, vehicle, destination or activity will be fully accessible or able to meet every individual requirement.

Travellers are responsible for carrying sufficient medication and any supporting medical documentation required during the journey.

18. Travel insurance

Comprehensive travel insurance is strongly recommended from the time your booking is confirmed.

Your policy should be appropriate for your destination, personal circumstances and planned activities. It should provide suitable protection for medical treatment, emergency assistance, medical evacuation, repatriation, cancellation, curtailment, delays, missed departures, baggage, personal liability and activities included in the itinerary.

You are responsible for reviewing the terms, exclusions and coverage limits of your insurance policy.

Any decision to travel without adequate insurance is made at your own risk.

19. Special requests

Special requests should be provided before the booking is confirmed.

These may include dietary preferences, allergies, bedding arrangements, room locations, celebrations, accessibility requirements and other personal preferences.

We will pass reasonable requests to the appropriate supplier, but we cannot guarantee that every request will be fulfilled unless it has been expressly confirmed in writing as part of your booking.

A request does not become a contractual commitment merely because it appears in correspondence or has been communicated to a supplier.

20. Activities and experiences

Some activities may involve physical exertion, uneven terrain, wildlife, water, heights or other inherent risks.

Participation is subject to local conditions, operator requirements and the traveller’s health, age and ability.

Travellers must follow all safety briefings and reasonable instructions provided by guides, rangers, drivers and activity operators.

An activity may be changed, postponed or cancelled where the operator considers conditions unsuitable or unsafe.

Where an activity is cancelled, any refund or alternative arrangement will depend on the operator’s conditions and the circumstances of the cancellation.

21. Wildlife experiences

Wildlife sightings and natural events cannot be guaranteed.

Wild animals move freely, and sightings may be affected by the season, weather, location, time of day and other natural conditions.

The absence of a particular wildlife sighting does not mean that the service has not been provided where the scheduled safari, excursion or nature experience has taken place.

Travellers must follow the instructions of guides, rangers and national park authorities and must not disturb, feed or endanger wildlife.

22. Traveller conduct

Travellers are expected to behave respectfully towards local communities, employees, guides, drivers, other guests, wildlife, cultural sites and the natural environment.

You must follow applicable laws, accommodation rules and reasonable health and safety instructions.

Luxurious Lanka or a supplier may refuse or discontinue a service where a traveller’s behaviour is threatening, abusive, unlawful, unsafe or seriously disruptive.

In such circumstances, the traveller may be responsible for resulting costs, and a refund may not be available for unused services.

23. Circumstances beyond our reasonable control

Circumstances beyond our reasonable control may include severe weather, natural disasters, epidemics, government action, border restrictions, civil disturbance, strikes, transport disruption, airport closure, security incidents, fire, flood or other exceptional events that could not reasonably have been prevented.

Where such circumstances affect your journey, we will provide reasonable assistance and seek practical alternatives where possible.

Additional accommodation, transport, meals, itinerary changes or other expenses arising from these circumstances may be payable by the traveller, depending on supplier terms, insurance coverage and applicable law.

Any refund for affected services will depend on amounts recoverable from the relevant suppliers and any legal rights available to the traveller.

24. Our responsibility

Luxurious Lanka will exercise reasonable care when designing, arranging and coordinating the services included in your confirmed booking.

Our responsibility applies only to services forming part of the booking made through Luxurious Lanka. We are not responsible for independently arranged services or activities that do not appear in your confirmed itinerary.

We will not be responsible for loss, damage, delay or additional expense caused by the traveller, inaccurate information supplied by the traveller, an unrelated third party, circumstances beyond reasonable control or a failure to follow reasonable advice and safety instructions.

Nothing in these Terms and Conditions is intended to exclude or restrict liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded.

25. Complaints during your journey

Please report any concern as soon as possible to your Luxurious Lanka contact, chauffeur-guide, guide, hotel or relevant service provider.

Prompt notification gives us and the supplier an opportunity to investigate and attempt to resolve the matter while you are travelling.

Where the matter cannot be resolved during the journey, please send a written complaint as soon as reasonably possible after completing your trip. Include your booking reference, a clear explanation of the concern and any relevant supporting information.

We will acknowledge, investigate and respond to the complaint within a reasonable period.

26. Website information

We make reasonable efforts to keep luxuriouslanka.com accurate and up to date. However, destination information, entry requirements, hotel facilities, photographs, itineraries and other website content may change.

Website content is provided for general information and travel inspiration. Your final quotation, itinerary and booking confirmation will take priority where there is any difference between those documents and general website content.

We do not guarantee that the website will always be available, uninterrupted or free from technical errors.

27. Website enquiries

Submitting an enquiry through the Luxurious Lanka website does not guarantee availability, pricing or confirmation of any travel service.

Information supplied through an enquiry form must be complete and accurate. We may contact you by email, telephone or another communication method you have provided to discuss your request.

A travel arrangement becomes confirmed only after the booking requirements described in these Terms and Conditions have been completed.

28. Intellectual property

Unless otherwise stated, the text, branding, design, graphics and original content published on luxuriouslanka.com belong to Luxurious Lanka or are used with permission.

Website content may not be copied, reproduced, republished, distributed, modified or commercially exploited without prior written permission.

You may save or print a limited amount of website content for your own personal, non-commercial travel-planning purposes.

29. External websites

Our website may include links to third-party websites for additional information or convenience.

Luxurious Lanka does not control these websites and is not responsible for their content, availability, security, accuracy or privacy practices.

Accessing a third-party website is at your own discretion and may be subject to that website’s own terms and conditions.

30. Personal information and privacy

We collect and use personal information where reasonably necessary to respond to enquiries, prepare travel proposals, administer bookings, process payments and coordinate travel services.

Personal information may need to be shared with hotels, airlines, transport providers, guides, activity operators, payment providers, government authorities and other suppliers connected with your booking.

Some of these organisations may be located in Sri Lanka, the Maldives or another country connected with your journey.

By making a booking on behalf of another traveller, you confirm that you are authorised to provide that traveller’s personal information.

31. Electronic communications

You agree that quotations, booking confirmations, invoices, payment instructions, itineraries and other notices may be provided electronically.

You are responsible for giving us a correct email address and telephone number and for checking your inbox, spam folder and other agreed communication channels.

Written acceptance by email, WhatsApp or another agreed electronic method may be treated as confirmation that you have accepted the relevant quotation, itinerary and booking conditions.

32. Changes to these Terms and Conditions

We may update these Terms and Conditions when our services, supplier arrangements, website practices or legal obligations change.

The version applicable to a confirmed booking will normally be the version supplied or available when that booking was confirmed, together with any booking-specific conditions accepted by the traveller.

The latest version published on our website will display its revision date at the top of this page.

33. Governing law and disputes

These Terms and Conditions and bookings made with Luxurious Lanka are governed by the laws of Sri Lanka.

Where a dispute arises, both parties should first attempt to resolve it through reasonable and good-faith communication.

Where a resolution cannot be reached, the dispute will be subject to the jurisdiction of the courts of Sri Lanka, without restricting any mandatory consumer rights that may apply to the traveller.

34. Severability

If any part of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

The affected provision will be adjusted or interpreted only to the extent reasonably necessary to make it valid and enforceable.
